MUNICIPAL COUNCIL OF MAVOKO

THE LOCAL GOVERNMENT ACT, CAP. 265

(CONTROL OF GRAZING) BY-LAWS 2009

IN EXERCISE of the powers conferred by Section 160 (b) and 201 of the Local
Government Act, the Municipal Council of Mavoko hereby makes the following By-
laws:-

Citation 1. These By-laws may be cited as the Municipal Council of
Mavoko (Control of Grazing) by-laws, 2009

Interpretation 2. In these By-laws, unless the context otherwise requires:-

“Council” means the Municipal Council of Mavoko.

“Permit” means a permit issued under these By-laws.

“Stock” means cattle, poultry, pigs, sheep or goats;

“Town Clerk” means the person at the time holding the office of the Town Clerk of Mavoko;

No grazing within 3. i) No person shall graze any stock within the jurisdiction of
jurisdiction the Council unless he is the holder of a permit in writing,
issued by the Town Clerk.
ii) The Town Clerk may issue a permit or refuse such permit subject to such conditions as he may deem necessary.
iii) Any person who contravenes paragraph (i) shall be guilty of an offence.

Permit 4. A permit issued under these By-laws may be revoked by the
Town clerk by notice in writing given to the holder thereof if:-

a. In opinion of the Council such revocation is necessary or desirable in the interest of grazing land available, or;

b. The holder or his agent or his employee is convicted of an offence under these By-laws.

Production of permit 5. i) Any officer of the Council authorised in writing by the
Town Clerk, may require of a person found grazing stock
within the jurisdiction of the Council to produce the permit
for inspection.
ii) An officer of the Council exercising the powers conferred by paragraph (i), shall produce his written authority if required to do so.
iv) Any person who fails to produce a permit for inspection when required to do so under paragraph (i) shall be guilty of an offence.

Fees 6. The fees set out in the current fees and charges shall be payable
to the Council on the issue of a permit.

Offence 7. Any person who is guilty of an offence under these by-laws
shall be liable to a fine not exceeding two thousand shillings or
six months imprisonment or both for first offenders and a fine
not exceeding three thousand shillings or nine months
imprisonment or both for second or subsequent offenders.
