BY- LAWS 2009
AND
PROHIBITING THE USE OF HAMALI CARTS AND HAND CARTS IN CERTAIN PUBLIC STREETS
THE TRAFFIC ACT
(CAP 403)
IN EXERCISE of the powers conferred by Section 118A (2) of the Traffic Act the Municipal Council of Mavoko hereby makes the following by-laws:-
THE CITY OF NAIROBI (CONTROL OF HAMALI CARTS AND HAND CARTS IN PUBLIC STREETS) BY- LAWS 2009
1) These by- laws may be cited as the Municipal Council of Mavoko (Control of Hamali Carts and Handcarts in Public Streets) by- laws 2009.
2) In these by- laws:-
“council” means the Municipal Council of Mavoko.
“hamali cart” means a wheeled cart for the carriage of goods propelled by human energy.
“hand cart” means a two or three wheeled cart for the carrying of goods propelled by human energy.
Control of 3) If the Council is satisfied that it is expedient for facilitating the hamali passage of traffic it may from time to time make an order as regards handcarts etc any public street in the Municipal prohibiting the use of the street by
hamali carts or hand carts either generally or subject to exceptions specified in the order and either at all times or at times, or days or during periods so specified.
Traffic rules 4) Any person authorized by the Council to propel a Hamali or Hand cart shall observe all the traffic rules and these By-laws.
Penalty 5) Every such Order shall be published in the Gazette and a person who uses a hamali cart or a hand cart or causes or permits a hamali cart or hand cart to be used in contravention of a prohibition imposed by an order made by the Council shall be guilty of an offence against these By-laws and liable on conviction to a fine not exceeding two thousand shillings or to imprisonment for a term not exceeding six months or both such fine and period of imprisonment.
