BY-LAWS 2009

CAP 265

IN EXERCISE of the powers conferred upon it by section 201 of the Local Government Act, Cap 265 the Municipal Council of Mavoko hereby makes the following By- Laws:

THE MUNICIPAL COUNCIL OF MAVOKO
(POLYTHENE CARRY BAGS BAN) BY-LAWS, 2009

Citation 1. These By-laws may be cited as The Municipal Council (Polythene Carry bags Ban) By-laws, 2009.

Interpretation 2. In these By-Laws unless the context otherwise requires:-

“Council” means the Municipal Council of Mavoko

“Polythene carry bag” means any plastic bag used for packaging storing, carrying or dispensing any article or commodity.

“Recommended thickness” means a thickness of not less than 30 microns.

“Vendor” means any person who sells articles or commodities packed or stored in polythene carry bags.

Prohibition 3. No person shall;

(a) Sell, import , manufacture, produce or store non bio degradable polythene carry bags of less than the recommended thickness within the jurisdiction of the Council;

(b) being a vendor, use such polythene carry bag for storing, carrying, dispensing or packaging of any articles or commodity;

(c) litter any public place with polythene carry bags.

Penalty 4. Any person who contravenes the provisions of these by-laws shall be guilty of an offence and liable on conviction to a fine not exceeding Kshs. two thousand and conviction and Kshs. three thousand and or imprisonment for a term not exceeding six months for a second conviction or subsequent conviction.
