IN EXERCISE of the powers conferred by section 201 of the Local Government Act the Municipal Council of Mavoko hereby makes the following By laws:-

Citation. 1. These By-laws- may be cited as the Municipal Council of Mavoko (Public Lavatories) Amendment By-laws 2009:

Interpretation 2. In these By-laws-

“council “ means the Municipal Council of Mavoko;

“mobile toilet convenience” means a public lavatory closet or urinal established and maintained by the Municipal Council of Mavoko or in partnership with any other person.

“person” means for the purpose of this by law will include an individual, body corporate, or a CBO or an Association.

“medical officer of health” means the person for the time being holding the office of the Medical officer of Health of the Council and includes his deputy;

“town clerk” means the Town Clerk of the Council;

Partnership 3. (a) The Council may partner with any person to provide public lavatory services at a fee agreed between the partners. Provided the above partnership is only for management Purposes.

(b) The Council may enter into a lease agreement with a person to manage the existing Public Lavatories.

(c) The partnership and lease agreement mentioned in (a) and (b) will be reviewed after every three years.

(d) The person managing the Public lavatory shall pay for the water, sewerage, electricity, refuse to the relevant bodies,

(e) The person Managing or leasing a public lavatory will pay the council a monthly fee or quarterly fee or such a fee as may be agreed between the council and that person,

Use of lavatory 4. A person who uses or enters a convenience shall not:-
a) enter any water closet without first paying any fee which the Council may charge for its use:-
b) willfully annoy or interfere in any way with the privacy of any other person using the convenience:

c) willfully and improperly soil any part of the convenience;

d) write on, mark or otherwise deface or damage any part of the convenience:

e) affix any picture or printed or written matter to any part of the convenience:

f) leave any litter in the convenience except in any receptacle provided for the purpose:

g) interfere with any officer or servant of the Council or any other person authorized to manage the convenience in the execution of his duties:

Person 5. (1) A person managing a convenience shall keep the convenience clean and in
managing hygienic conditions at all times.

(2) The disposal of liquid waste from a mobile toilet should be hygienic and
disposed as directed by the council.

Permit 6. (1) The mobile toilet shall be permitted by the Town Clerk on the advise of
Medical Officer of Health.

(2) Any other person carrying on convenience services within the city will be
required to obtain a permit from the town clerk on the advise of Medical
Office of Health at a fee as per the gazetted Council latest fees and charges.

Penalties 7. Any person who contravenes any of the provisions of these By-laws shall be guilty of an offence and shall be liable to a fine not exceeding two thousand shilling or to imprisonment for a term not exceeding six months or to both such fine and imprisonment.
